[Legal entity name] respects copyright and responds to notices of claimed infringement under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). This page explains how to send a notice, how to respond to one, and what happens to repeat infringers.
Designated agent
Send copyright notices and counter-notices to our designated agent:
[DMCA agent name][Legal entity name]
[DMCA agent address]
Phone: [DMCA agent phone]
Email: dmca@example.com
The agent handles copyright notices only. Other reports go through the report form, where you can also send a copyright report by choosing "Copyright or trademark"; we treat it as a notice if it contains everything listed below.
Sending a takedown notice
If you believe content on this site infringes a copyright you own or control, send a written notice that includes:
- your physical or electronic signature;
- a description of the copyrighted work you say is infringed (or a list, if several works are covered by one notice);
- the address (URL) on this site of each item you want removed, with enough detail for us to find it;
- your name, postal address, phone number and email address;
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorised to act for the owner.
When we receive a complete notice we remove or disable access to the material promptly, tell the member who uploaded or bought it where that applies, and keep a record. Incomplete notices may not be acted on; we will tell you what is missing. Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing may be liable for damages.
Counter-notice
If material you posted or rely on was removed and you believe that was a mistake, you may send a counter-notice that includes:
- your physical or electronic signature;
- a description of the material that was removed and the address where it appeared before removal;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification;
- your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which we may be found) and that you will accept service of process from the person who sent the original notice.
We forward a valid counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we may restore the material 10 to 14 business days after we received the counter-notice.
Repeat infringers
We close the accounts of members who are repeat infringers in appropriate circumstances. An account that is the subject of two or more valid notices that were not successfully countered may be closed without refund, and we may refuse new accounts from the same person.
